0. Preamble

Cyberté Création SARL identified as follows, Siret 478 579 329 - RCS Romans, located at 169 impasse de Malgras - 26170 Buis les Baronnies, is the provider of this website.

Internet customers and Cyberté Création are only contractually bound insofar as Cyberté Création makes available to customers, within the framework of these General Conditions, an interface enabling them to make sales with Moryan Décoration. Cyberté Création is neither a representative, nor an agent, nor a mediator of the Customers, nor an employee nor an employer of Moryan Décoration.

When the Customer clicks on the "validate your order" button, he declares that he accepts the order and the entirety of these general conditions of sale fully and without reservation.

The photographs illustrating the products are not part of the contractual field. If errors were introduced there, in no case, the responsibility for Moryan Decoration could not be committed. All the products presented on the site are proposed within the limit of the available stocks of Moryan Decoration and its suppliers.

The shortages of stock could not put in question the responsibility of Moryan Decoration.

3. Order

The automatic recording systems are considered as proof of the nature, the content and the date of the order. The Customer receives on the e-mail address that he will have communicated the confirmation of his order. The sale will be concluded only as from this confirmation of order. Moryan Décoration reserves the right to cancel any order of a Customer with whom would exist a dispute relating to the payment of a former order. The information stated by the purchaser, at the time of the order taking engage this one: in case of error in the wording of the coordinates of the recipient, the salesman would not know how to be held responsible for the impossibility in which it could be to deliver the product.

The ordered products remain the property of Moryan Decoration until the final and complete payment of their price (Law of May 12th, 1980).

All the offers of product have prices indicated in euros. The VAT is not applicable according to article 293 B of the CGI. The price indicated in the order confirmation is the final price, including postage and packaging depending on the recipient.

Any order whatever its origin is payable in euros.

Moryan Décoration reserves the right to modify its prices without notice and at any time, but commits itself to apply the tariffs in force which will have been indicated to the Customer at the time of the order, subject to availability at this date.

Moryan Décoration accepts orders within the limit of available stocks. The Customer is informed of the availability of the products on the information sheet of the product. If, despite the vigilance of Moryan Décoration, an ordered product is unavailable, the customer will be informed by e-mail as soon as possible and a suitable solution will be proposed, either: a new period of availability of the product, an exchange of the unavailable product for another product or the reimbursement of the said product. In this case, Cyberté Création will proceed with the reimbursement by bank cheque in the name and address of the Customer who placed the order.

The price invoiced to the customer is the price indicated on the order confirmation sent by Moryan Décoration.

The price of the products is payable in cash the day of the effective order. The payment is carried out by bank card carrying the acronym CB, by bank or postal check emitted by a bank domiciled in France, by bank transfer, by paypal, the possible bank charges being the responsibility of the Customer. Cheques are to be made payable to Cyberté Création and must be sent to : Cyberté Création SARL, 169 impasse de Malgras - 26170 Buis les Baronnies.

An order is reserved for 10 days. Beyond this period, without receipt of payment, the order is cancelled. The order will only be processed on receipt of payment and after validation.

Cyberté Création subscribes to the secure online payment system SPPLUS of La Banque Postale, as an approved distance selling merchant.

Payment is made directly to the bank's server in a secure environment without passing through the store's server.

In the event that the bank payment centers concerned refuse the payment, the order will be automatically cancelled and the Customer will be notified by e-mail.

The orders are delivered by Moryan Décoration for the destinations indicated by the scale of the postage and packing and at the rate indicated according to the weight of the total order.

After confirmation of order, the deliveries are carried out by the Post office.

For deliveries outside metropolitan France, the customer agrees to pay all taxes due on the import of products, customs duties, value added tax, and any other taxes due under the laws of the country where the order is received.

Moryan Décoration et Cyberté Création is in fact released from any legal responsibility if the payment of taxes is not made by the customer. Any delays do not entitle the purchaser to claim damages.

The delivery times are given as an indication and in no case guaranteed by Moryan Decoration.

If the delivery by the Post Office could not be made and the parcel returned, Moryan Décoration reserves the right to refund the price, all the shipping costs remaining at the charge of the Customer.

Always check your package upon arrival. In case of damage or missing items, the Customer must formulate reserves in writing on the delivery note and confirm these reserves to Moryan Decoration by registered mail and by e-mail within 48 hours.

In case of apparent defects, the buyer benefits from the right of return under the conditions provided in this document.

Any return of product can be done only after agreement of Moryan Décoration.

The products ordered on the site can be returned in case of non conformity with the order made by our services or in case of defect. These products must be returned in their original packaging, accompanied by the order form and the mention of the defect noted.

The articles benefiting from a personalization (letters in color, raw name or in color) will be neither taken back nor exchanged. The products will not be replaced in case of use, opened or degraded because of its use, incomplete or damaged.

It is reminded that in case of damage or missing products, the customer must express his reserves on the delivery note of the carrier and notify Moryan Decoration within 48 hours by registered letter. In the absence of justified reserves, Moryan Décoration can refuse the replacement or the refund of the product.

The retraction request must be done within 14 days from the reception of the parcel, the post office slip being proof. You then have 14 days to return the product.

Upon receipt of the product in due form and after examination of the product, Moryan Decoration will proceed, according to your choice, either to the exchange or to the refund of the product concerned.

All refunds will be made using the same method of payment as for the purchase by Cyberté Création in the name and address of the customer who placed the order.

You have 14 days (from receipt of the products) to form an opinion. In case of exchange or refund, send back the new product(s) in its (their) original packaging, intact, accompanied by all the possible accessories, instructions for use and documentations to the following address

This does not apply to the articles benefiting from a personalization. In case of exercise of the right of retraction, Moryan Décoration is held with the refunding of the sums paid by the Customer, without expenses, except for the expenses of return. The refund is due within a maximum of 15 days.

The present contract is subjected to the French law. Moryan Decoration cannot be held responsible for damages of any kind, material or immaterial or physical, which could result from a bad functioning or from the bad use of the marketed products. It is the same for the possible modifications of products resulting from the manufacturers. The responsibility of Moryan Decoration will be, in any case, limited to the amount of the order and would not know how to be questioned for simple errors or omissions which could have remained in spite of all the precautions taken in the presentation of the products In case of difficulties in the application of the present contract, the purchaser has the possibility, before any action in justice, to look for an amicable solution in particular with the assistance of a professional association of the branch, an association of consumers or any other council of his choice. It is reminded that the search for an amicable solution does not interrupt the "short period" of the legal guarantee, nor the duration of the contractual guarantee. It is reminded that as a general rule and subject to the appreciation of the Courts, the respect of the provisions of the present contract relating to the contractual guarantee supposes that the purchaser honors his financial commitments towards the seller.

Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in the one who takes the trouble to expose his situations. In the event of a dispute, the Customer shall first contact the company to obtain an amicable solution.

Failing this, the Commercial Court of Aix-en-Provence has sole jurisdiction, regardless of the place of delivery and the method of payment accepted.

In all the cases Moryan Decoration could not be held for person in charge for non respect of the regulatory and legislative provisions in force in the country of reception, the responsibility of Moryan Decoration is systematically limited to the value of the product put in question, value has its date of sale and this without possibilities of recourse towards the mark or the company producing the product.

In any hypothesis, the Customer benefits from the legal guarantee of eviction and hidden defects (Art.1625 and following of the Civil code). On the condition that the buyer proves the hidden defect, the seller must legally repair all the consequences (art.1641 and following of the Civil Code); if the buyer goes to court, he must do so within a "short period" from the discovery of the hidden defect (art.1648 of the Civil Code). 13. Legal information

The information collected for the purposes of distance selling is mandatory, this information is essential for the processing and delivery of orders, the establishment of invoices and contracts of guarantee. Failure to provide this information will result in the order not being validated. In accordance with the French law "Informatique et libertés" n°78-17 of 6 January 1978, you have the right to access and rectify data concerning you, directly via the Customer Area or by mail addressed to Cyberté Création.
The user is informed that this automated processing of information, in particular the management of users' e-mail addresses, has been declared to the CNIL under number 1036334 concerning the les-creatifs.com site. Furthermore, Cyberté Création undertakes not to communicate or resell its information to a third party without the Customer's agreement.

The Customer may consult the status of his orders at any time from the Customer Services area, using his customer ID and his password which he has chosen himself.
